🔹 No Surgical Negligence – Independent tests and medical reviews confirmed there was no evidence of surgical errors or complications related to the patient’s death.

🔹 Baseless Impairment Claims – The judge allowed Dr. Monash’s ex-wife to testify about false claims that she made three years prior in order to obtain parenting time. To try and substantiate her claims, the plaintiff’s attorney took depositions from every person Dr. Monash worked with at TMC. After 23 depositions, not a single doctor, nurse, or healthcare provider testified to ever seeing or having any concerns of impairment.

🔹 The Trial Was Flawed – Court records show that 80% of the evidence presented at trial had nothing to do with the actual patient’s case. The trial judge allowed in misleading information that was irrelevant to the medical facts, and the juror’s that voted against Dr. Monash admitted that it was not related to his medical care, but cited false claims from his ex-wife. The jurors that voted in favor of Dr. Monash admitted that there was no evidence that the patient died from negligent care.

🔹 False Mortality Reporting – The plaintiff’s attorney hired a doctor to falsify Dr. Monash’s mortality rate in order to distract the jury, and make him look bad. He failed to report Dr. Monash’s actual mortality rate of 5 in 5500 bariatric surgeries, less than half the national average.

🔹 The Case is Under Appeal – Legal experts say that the verdict is likely to be overturned due to major legal errors and a lack of medical basis. “The court allowed prejudicial and irrelevant evidence that had no place in a medical malpractice trial,” said Christopher J. Smith, Esq., a legal expert representing Dr. Monash. “When we remove the noise and focus on the facts, the evidence simply does not support the claims made against him.”
